Booking Terms & Conditions

The following Booking Terms together with the general information contained on this website www.rivercatcher.co.uk form the basis of your contract for your holiday. Please read carefully as they set out our respective rights and obligations.

In these Booking Terms, “guest”, “you” and “your” means the person named on the booking confirmation and all other persons staying at the property during the rental period. “us” and “our” relate to Rivercatcher and it’s management team. All reservations are made subject to these Booking Terms.

1. CONDITIONS OF HIRE

Once you confirm your holiday with us we enter into a binding contract with each other. The properties of Rivercatcher are used as holiday accommodation and therefore exempt from security of tenure under the Rent Act.

2. MAKING A BOOKING

Bookings can be made by online at www.rivercatcher.co.uk or by contacting the Rivercatcher office. Once Rivercatcher have received your booking request we will, subject to availability, confirm your stay by email. Please check the details & contact Rivercatcher immediately if there are any errors or omissions to any information which appears in the confirmation or any other document as it may not be possible to make changes later. Rivercatcher regret we cannot accept any liability if we are not notified of any inaccuracies in any document within 5 working days of its transmission. A non-refundable deposit of 25% of the holiday value is required to confirm a booking. The balance is due 8 weeks before the date of arrival, any monies paid cannot be returned unless the cancellation is made by Rivercatcher. Should you need to cancel with less than twelve weeks to the date of the booking then you will be bound by this agreement to pay us in full for that booking. Payment must be made whether or not you have at the time of cancellation paid in full for the booking. You would therefore be advised to take out holiday cancellation insurance to cover you for that eventuality. Late bookings: all monies must be paid in full on booking.

3. NO SMOKING

All properties are strictly no smoking.

4. FAMILIES ONLY

Rivercatcher is a ‘families only’ holiday retreat and the holiday organiser must be age 21 or over. Unless otherwise agreed in writing, Rivercatcher reserve the right to terminate any bookings, without refund, which are found to be of young people not supervised by parents / adults, even though the booking may have been made by a parent / adult.

5. YOUR CONTRACT

This contract and all matters arising out of it are governed by United Kingdom law. Any dispute arising out of or connected with your holiday will be dealt with by the Courts of United Kingdom.

6. CHANGES & CANCELLATION BY YOU

Once a holiday is booked we have entered a legally binding contract. Should you wish to make any changes to your confirmed booking, you must notify us by email as soon as possible. Whilst we will endeavor to assist, we cannot guarantee we will be able to meet any such requests. If you need to cancel (including medical and weather reasons) then no refund will be due. A non-refundable deposit of 25% of the holiday value or £150 whichever is greater is required to cancel a booking. Holiday cancellation insurance should be taken out to cover these circumstances. Guests are strongly urged to arrange cancellation insurance – this is not included in the rental and guests should make their own arrangements. This should include delay, cancellation or abandonment of your holiday in the event of closed or dangerous roads caused by adverse weather conditions in the UK.

7. CHANGES & CANCELLATIONS BY RIVERCATCHER

Occasionally Rivercatcher have to make changes to and correct errors on the website descriptions and other details both before and after bookings have been confirmed and cancel confirmed bookings. Whilst Rivercatcher always endeavor to avoid changes and cancellations, we must reserve the right to do so. If Rivercatcher have to make a significant change to or cancel your booking we will tell you as soon as possible and refund all monies paid. Rivercatcher will endeavor to offer you an alternative should a significant change or cancellation occur. Rivercatcher regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation and cannot be held responsible beyond full refund of monies received. Very rarely, Rivercatcher may be forced by “force majeure” (see clause 17) to change or terminate your stay after arrival but before the scheduled departure. This is extremely unlikely but if this situation does occur Rivercatcher regret we will be unable to make any refunds, pay you any compensation or meet any costs or expenses you incur as a result.

8. GUEST RESPONSIBILITY

The Hirer undertakes to keep the premises and all furniture, fixtures, fittings and effects in or on the premises in the same state of repair and condition as the same are in at the commencement of the letting and shall report and pay to the owners the value of any part of the premises, furniture, fittings and effects so destroyed or damaged as to be incapable of being restored to its former condition.

Any problems found with any appliance or fixture or fitting must be reported to the on-site managers who will ensure within a reasonable time that this is repaired or alternative arrangements made. Under no circumstances should any guest attempt repairs to the property or its contents. This will invalidate service contracts, warranties and agreements and charges for such repairs will then pass to the Hirer. Liability for damage done to the property of equipment or for excessive extra cleaning necessary on vacation is the responsibility of the person who completes the booking form.

9. SECURITY DEPOSIT

All of our cottages require a Security Deposit is required in addition to the advertised rental, this will be returned to you with 14 days from departure unless the cottage has been left in an unacceptable condition. Charges for these liabilities will be deducted from the Security Deposit – an account will be sent to you after your holiday and any refund will be returned. If the costs exceed the Security Deposit, an invoice will be sent to you. These costs include loss of keys, breakages etc which must be reported to us before departure.

10. KEYS, MAP & DIRECTIONS

Arrangements for key collection, a map & directions on how to reach the property will be emailed to the you on receipt of final payment.

11. LOST PROPERTY

If any belongings are left behind and a request is made to send them on we reserve the right to charge a minimum fee of £5 to cover post and packaging.

12. OVERCROWDING

Only the number of guests stated at the time of booking will be allowed to stay in the property, unless otherwise agreed in writing by the owners. A cot may only be occupied by a child aged 24 months or less. Rivercatcher reserves the rights to refuse entry to the entire party and immediately terminate a booking if this condition is not observed.

13. PROBLEMS

Rivercatcher are most anxious that all guests have an enjoyable time. In the event of a problem you the guest should contact us immediately. You must undertake to do your best to resolve or minimise the problem in order to avoid any prejudices that could result and are obliged to give us the time necessary to resolve the problem. No complaints will be considered unless raised immediately during the course of hire period to enable the complaint to be verified and corrected as soon as possible. Should there be no written complaint supplied as above specified and you leave the accommodation prematurely and without an explicit authorisation by Rivercatcher, you forfeit your rights for any refund or part refund of the rental price. Complaints received at the end of the stay will not be taken into consideration and no refund or part refund will be given.

Please note that we are not an official tourist establishment but are privately owned. As such, there is no standard or categories that are internationally recognised; indeed they reflect the architecture and furnishings, local traditions and the personal taste of the Rivercatcher management.

14. LIABILITY

Except in respect of death or personal injury caused by the negligence of Rivercatcher or our employees, Rivercatcher will not be liable for any accident damage direct or consequential loss, injury expense or inconvenience, whether to person or property which the guest or any other person may suffer arising out of or in any way connected with the letting howsoever caused. Rivercatcher do not accept responsibility if any death, personal injury, failure or deficiency of your accommodation arrangements is not caused by any fault of theirs. When we talk about “fault” above, this means failure by Rivercatcher to use reasonable skill and care in performing or providing the service in question. Please note it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim.

Rivercatcher will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: –

  • the fault of the person(s) affected or any member(s) of their party or
  • the fault of a third party not connected with the provision of your accommodation which Rivercatcher could not have predicted or avoided or
  • an event or circumstance which could not have predicted or avoided even after taking all reasonable care (see clause 17)
  • in addition, Rivercatcher will not be responsible where you do not enjoy your stay or suffer any problems because of a reason you did not tell Rivercatcher about when you booked your stay or where any problems you suffer did not result from any breach of contract or other fault of Rivercatcher or any losses, expenses, costs or other sum you have suffered relate to any business.

Please note Rivercatcher cannot accept responsibility for any services that do not form part of our contract.

15. FORCE MAJEURE

We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of “force majeure”. In these Booking Conditions, “force majeure” means any event which Rivercatcher could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

17. PRICES AND WEBSITE ACCURACY

The information and prices shown on the Rivercatcher website may have changed by the time you come to book your stay. Whilst every effort is made to ensure the accuracy of the website and prices at the time of requesting the booking, regrettably errors do occasionally occur. You must therefore ensure you check all details of your stay (including the price) on your booking acceptance. Whilst representations both verbal and visual contained on the Rivercatcher web page are made in good faith are carefully scrutinised, neither such verbal and visual representations form part of the contract. Rivercatcher will not accept any liability arising out of changes of circumstances affecting the property between publish date of the web and the period covered by any booking by a guest.

18. BEHAVIOUR

Rivercatcher expect all guests to have consideration for other people. If in the reasonable opinion of Rivercatcher or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to the property, or in any way damage our reputation and/or, Rivercatcher are entitled, without prior notice, to terminate the occupation of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation. Rivercatcher will have no further responsibility toward such person(s). No refunds will be made and Rivercatcher will not pay any expenses or costs incurred as a result of the termination.

19. SPECIAL REQUESTS

If you have any special request, please advise us at the time of booking. Although Rivercatcher will endeavour to meet any reasonable requests we regret we cannot guarantee any request will be met. Rivercatcher regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfillment of a particular request. All such bookings will be treated as “standard” bookings subject to the above provisions on special requests. If you or any member of your party has any medical problem or disability that may affect your stay, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking, cancel when we become aware of these details.

20. RIVERCATCHER MANAGEMENT ACCESS

You the guest must allow members of our management team, housekeeper and tradesmen access to the property at any reasonable time during your occupation. We reserve the right to enter a property at any time but will endeavour to do so when convenient to the occupier.

21. BABY EQUIPMENT

Where we have agreed to make available baby equipment such as a travel cot or high chair this is done for your convenience and we are not responsible for its use. It is the guests’ responsibility to acquaint themselves with each piece of equipment and ensure it is safe for their own child – in the event of any doubts regarding the suitability or safety of a piece of equipment guests are strongly advised not to use it. As stated in condition 16 above, Rivercatcher and it’s employees will not be liable for any accident damage direct or consequential loss, injury expense or inconvenience, whether to person or property which the guest or any other person may suffer arising out of or in any way connected with the letting howsoever caused.

22. DOGS

Dogs are permitted with the consent of Rivercatcherand for the consideration of other guests are to be kept under control at all times and exercised under your supervision. Dogs are not permitted in the bedrooms or on the furniture and Rivercatcher cannot accept responsibility for their safety. Dogs are accepted on the condition that they are not allowed to foul in the garden areas and otherwise in the vicinity of the property. The dog owner will clean up any mess caused. Dogs must not be left in the property unsupervised as this can result in considerable damage to the property and distress to the dog. That they are not allowed in the communal areas unsupervised at any time. Failure to comply will render the contract terminated and you may be asked to remove the dog from the premises.

23. WI-FI ACCESS TERMS

This agreement sets out the terms and conditions on which wireless internet access (“the Service”) is provided to you, a guest of one of our cottages in consideration for your custom, your agreement to these terms and conditions and your agreement to allow Rivercatcher to send to you by e-mail our promotional and marketing material.

23.1. Extent of the Service

23.1.1 Rivercatcher do not recommend in particular the use of any websites (or other internet related services) (“Internet Services”) and your use of Internet Services is carried out entirely at your own risk.
23.1.2 Rivercatcher have no responsibility for, or control over, the Internet Services you access and do not guarantee that any services are error or virus free. 24.1.3 Rivercatcher have no responsibility for, or control over, the information you transmit or receive via the Service.
23.1.4 Save for the purposes of network diagnostics Rivercatcher do not examine the use to which you put the Service or the nature of the information you send or receive.
23.1.5 Rivercatcher do not guarantee:
23.1.5.1 the availability of the Service;
23.1.5.2 the speed at which information may be transmitted or received via the Service; or
23.1.5.3 that the Service will be compatible with your equipment or any software which you use.
23.1.6 [Whilst Rivercatcher take reasonable steps to ensure the security of the Service and to prevent unlawful access to information transmitted or received using the Service] we do not guarantee the security of the information which you may transmit or receive using the Service or located on any equipment utilising the Service and you accept that it is your responsibility to protect your information and have adequate security (in terms of equipment and procedures) to ensure the security, integrity and confidentiality of your information and data.
23.1.7 Rivercatcher reserve the right at all times to withdraw the Service, change the specifications or manner of use of the Service, to change access codes, usernames, passwords or other security information necessary to access the service.

23.2. Your Use of the Service

23.2.1 You must not use the Service to access Internet Services, or send or receive e-mails, which:

  • are defamatory, threatening, intimidatory or which could be classed as harassment;
  • contain obscene, profane or abusive language or material;
  • contain pornographic material (that is text, pictures, films, video clips of a sexually explicit or arousing nature);
  • contain offensive or derogatory images regarding sex, race, religion, colour, origin, age, physical or mental disability, medical condition or sexual orientation;
  • contain material which infringe third party’s rights (including intellectual property rights);
  • in the reasonable opinion of Rivercatcher and the Owner may adversely affect the manner in which we carry out our business; or
  • are otherwise unlawful or inappropriate;

23.2.2 Music, video, pictures, text and other content on the internet are copyright works and you should not download, alter, e-mail or otherwise use such content unless certain that the owner of such works has authorised its use by you.
23.2.3 Rivercatcher may terminate or temporarily suspend the Service if we reasonably believe that you are in breach of any provisions of this agreement including but not limited to clauses 2.1 to 2.3 above.
23.2.4 Rivercatcher recommend that you do not use the service to transmit or receive any confidential information or data and should you choose to do so you do so at your own risk.
23.2.5 The Service is intended for consumer use only. In the event that you use the Service for commercial purposes we would specifically refer you to clause 5.2 below.

23.3. Criminal Activity

23.3.1 You must not use the Service to engage in any activity which constitutes or is capable of constituting a criminal offence, either in the United Kingdom or in any state throughout the world.
23.3.2 You agree and acknowledge that Rivercatcher may be required to provide assistance and information to law enforcement, governmental agencies and other authorities.
23.3.3 You agree and acknowledge that Rivercatcher may keep a log of the Internet Protocol (“IP”) addresses of any devices which access the Service, the times when they have accessed the Service and the activity associated with that IP address
23.3.4 You further agree Rivercatcher is entitled to co-operate with law enforcement authorities and rights-holders in the investigation of any suspected or alleged illegal activity by you which may include, but is not limited to, disclosure of such information as we have (whether pursuant to clause 3.3 or otherwise), and are entitled to provide by law, to law enforcement authorities or rights-holders.

23.4. Our Use of your Information

23.4.1 Subject to clauses 3.3 and 3.4 above we confirm that Rivercatcher shall use the contact details you provide to Rivercatcher solely for the purposes of contacting you with marketing information, updates, promotions and special offers relating to our business.

23.5. Other Terms

23.5.1 You agree to compensate Rivercatcher fully for any claims or legal action made or threatened against Rivercatcher by someone else because you have used the service in breach of these terms and conditions, and in particular clause 2.1 to 2.3 and 3.1 above.
23.5.2 Whilst Rivercatcher do not seek to limit our responsibility for fraudulent misrepresentation or if you are injured or die as a result of our negligence we have no responsibility (to the extent permitted by law) to compensate you (whether or not we are negligent) for any direct financial loss, loss of profit, revenue, time, anticipated savings or profit or revenue, opportunity, data, use, business, wasted expenditure, business interruption, loss arising from disclosure of confidential information, loss arising from or in connection with use of the service or inability to use or access the service or a failure, suspension or withdrawal of all or part of the service at any time or damage to physical property or for any other similar direct loss that may arise in relation to this agreement whether or not we were advised in advance of the possibility of such loss or damage.
23.5.3 Rivercatcher agree that neither this agreement does not allow either party to act as, or hold themselves out as, acting as an agent of the other party and that that the terms of this agreement are not enforceable by a third party under the Contracts (Rights of Third Parties) Act 1999.
23.5.4 This agreement is governed by the law of England and Wales and is subject to the non-exclusive jurisdiction of the English courts.
